What Is Probate?

Probate is the court-supervised process of settling a person's estate after death. The court confirms whether there is a valid will, appoints an executor (or an administrator when there is no will), and oversees the work that follows, locating and valuing assets, notifying heirs and creditors, paying final debts and taxes, and distributing what remains to the rightful beneficiaries.

In Illinois, probate is generally required when someone dies owning real estate in their own name, or more than $100,000 in assets without designated beneficiaries. For Chicago families, that means a case in the Probate Division of the Circuit Court of Cook County at the Daley Center, with its own filings, deadlines, notices, and court dates. The process commonly takes a year or more, and small mistakes can add months.
